3. | TERM 會籍期限 / Renewed Automatically 自動續期 |
I, the undersigned, hereby agree and acknowledge that all memberships of EFX24 are either month-to-month or annual (when paid in full), and payments are due in advance. Such membership will be renewed automatically even though the full membership term has expired (EFX24 will charge my membership fee each and every month equivalent to 1-month membership in accordance with the price list in effect at the time being (which may be revised from time to time), until I terminate the membership in the situations set out hereinbelow) and payment will still be made through my designated automatic drafts. The membership of EFX24 can only be terminated upon (1) the expiry of the full minimum term and (2) not less than thirty (30) days written notice have been given to EFX24 to terminate the membership (by completing the relevant Termination Form). EFX24'S RULES AND REGULATIONS
EFX24的使用規則和規例
1. The Member acknowledges that EFX24 operates under rules and regulations established for the safety and protection of its members and agrees to be bound by such rules and regulations. as well as the rules and regulations subsequently approved and posted or otherwise published by EFX24. Such rules and regulations in effect from time to time are incorporated into this Agreement by reference. Facilities, equipment, hours, service, regulations, and policies are subject to change from time to time without prior notice, in the sole and absolute discretion of EFX24. Member agrees to accept such reasonable change(s) as a condition of membership.
會員確認為保障其會員的安全和權益，EFX24 將按照其訂立規則和規例營運，並同意遵守這些規則和規例，以及EFX24其後不時制定和公佈的規則和規例，這些規則和規例將不時以引用方式加入此協議。

2. The Member recognizes that:- 會員知悉:-
a) Under no circumstances shall Member move exercise equipment or use the equipment in any manner not authorized by EFX24;

b) Members are required to
wipe down all equipment with the supplies provided by EFX24 after each use, and
to tidy up and return the equipment to its original position.

c) This membership is for the Member only and the Membership shall not give access to another individual. Should there be any violation of this rule by the Member, EFX24 reserve the right and discretion to immediately terminate the Membership and demand for monetary penalty in the sum of $__________ or equivalent to membership fee for 1-month membership in accordance with the Price List in effect at the time being, whichever higher against the Member;
此會籍只限會員使用，而不能供其他人仕進入。如發現會員違反此規定，EFX24有權即時終止會籍並向會員收取$ ____________. 或等同當時適用的收費表上一個月會籍的月費(以較高者為準)作為罰金;
d) The Member shall not misuse the equipment and only use the equipment in accordance with the guidelines posted in the Facility;
會員不可誤用器材，應只根據設施裡展示的守則使用器材。
e) The Member shall be at least eighteen (18) years of age, unless otherwise authorized by EFX24.
會員須最少年滿18歲，除非EFX24另作許可。
f) The Member shall conduct themselves in a quiet, well-mannered fashion so as not to cause any disturbance which may interfere with the use and enjoyment of the Facility by any other member. Profanity or indecent language and/or behavior will not be tolerated. Any conduct deemed by EFX24, in its sole discretion, to be offensive, potentially harmful. dangerous or abusive will not be tolerated, and shall be grounds for termination of Member’s membership by EFX24:
會員應以寧靜，良好品格的方式進行活動，盡量避免逕生影響其他會員使用設施的滋擾。任何褻瀆、猥褻的用語和/或行為都不會被容忍。如EFX24 在其單獨酌情權下認為任何行為是冒犯，有機會損害他人，危害或虐待他人，將不會容忍以及會成為EFX24終止會籍的原因:
g) EFX24 shall not be responsible for any lost or stolen items
EFX24 不會負責任何違失或失竊的物品;
h) The Member should not occupy any equipment for an extended period of time and should allow others waiting to use such equipment to work into their rotation; and

i) The climate of the Facility is controlled by EFX24 and is set to provide the optimum exercise environment for the majority of its members. The Member shall not change or seek to change any environmental controls and shall never prop open any doors or windows to the Facility for any purpose.

3. Alcohol, drugs (including steroids), and smoking are prohibited within the Facility. The Member agrees not to use the Facility or engage in any activity at EFX24 while under the influence or drugs, alcohol, or medication that may impair Member's ability to operate the equipment. No weapons of any kind are allowed. No photography, videotaping, filming or audio recording is permitted within the Facility without the express written consent of EFX24’s management. EFX24 reserves the right in its sole discretion, to limit the consumption of food or beverages, or to the use of outside equipment within the Facility. Gambling or gaming is prohibited within the Facility or on the premises.
設施内嚴禁飲酒，吸毒(包括類固醇)和吸煙，會員同意不會在毒品，酒精或藥物以致影響會員操作器材的情況下使用設施或進行任何EFX24的活動。
嚴禁使用任何類型的武器。嚴禁在設施範圍內拍照、攝錄、拍攝影片或錄音，除非已事先獲得EFX24管理層的許可。EFX24 保留權利在其單獨酌情權下規管在設施範圍内食用食物或飲品，或使用外來的器材。嚴禁在設施範圍内或中心内進行賭博或遊戲。
4. EFX24 requires that Members wear appropriate clothing and footwear while in the Facility. Appropriate clothing includes gym shorts, T-shirts, jogging suits, aerobic wear and sweat outfits. Street clothing and jeans are not considered appropriate clothing. Street shoes and black-soled shoes are prohibited within the Facility. The Members agrees to have a cloth towel during workouts to protect and clean the equipment after Member’s use.
EFX24要求會員在設施內須穿著適當衣物和鞋履。適當衣物包括健身短褲、T-Shirts、跑步裝束、拉筋裝束和運動裝束，街頭服裝和牛仔褲不視為適當衣服，設施內嚴禁穿著街頭服裝和黑皮鞋。會員同意在運動時自備毛巾以在使用器材後進行保護和清潔。
5. EFX24 may update their policies and practices in relation to the use of the Facility from time to time. They will notify the Members about the significant changes as made to its policies or practices by placing a notice in respect of such changes on its website or in its Facility;
EFX24可能不時對其設施的使用政策和守則進行更新，如有任何前述的更新，將於其網站展示通知以知會各會員相關使用政策和守則的重大更改。
6. The Member agrees and acknowledges that his use and enjoyment of the Facility and/or services provided by EFX24 under this Agreement may be limited problem, difficulties and/or incapability of himself/herself and that the Member is still obliged to make full payment of the Membership Fees and other charges under this Agreement and EFX24 shall not in any event refund in whole or in part any of the fees payable by the Member under this Agreement.
會員同意和知悉其自身存在的問題、困難和/或喪失能力的情況有可能妨礙會員全面使用及/或享受根據此協議由EFX24提供的設施和/或服務，
而會員仍有責任根據此協議全數支付會籍和其他相關費用，EFX24在任何情況下均不會向會員退還根據此協議已由會員支付的任何費用。
7. Members are strictly
prohibited from receiving paid or unpaid fitness instruction from coaches not
affiliated with EFX24. All fitness coaching must be authorized and approved by EFX24.
Any violation of this clause may result in the immediate termination of the
member's membership.
會員嚴禁接受EFX24以外的教練提供授薪或非授薪的健身指導，所有健身教學必須經過健身室的授權和批准。任何違反此條款的行為將可能導致會員會籍的即時中止。
8. Members
are informed that they may apply for a membership suspension under the terms of
this agreement, with a written request submitted at least 30 days in advance,
and the payment of a monthly suspension fee of $250. The minimum suspension
period is one full calendar month, with a maximum of three months allowed
within the same year or contract period (based on the earliest expiration
date). The total months of membership suspension will not count towards the
service commitment period and must be made up after the membership contract
expires. Any gifted months will be compensated after the completion of the
service commitment period.
During
the suspension period, members are prohibited from entering or using any
facilities and/or services provided by EFX24. The decision to suspend
membership is at the sole and absolute discretion of EFX24 and may take effect
immediately.
會員清楚可在根據本合約條款申請暫停會籍，需經不少於30天的書面申請，並繳交每月$250的暫停會籍費用。暫停會籍的最短時間為一個完整曆月計算，最多可在同一年度或合約期內（以最先到期的日子為準）暫停3個月。申請暫停會籍的總月數不計算在服務承諾期內，且需要在合約會籍屆滿後補回，而贈送的月份將於完成服務承諾期後補回。

9. When collecting your personal data,
we will take all reasonable measures to ensure its confidentiality. The
collected personal data will be used solely for internal purposes or for facial
recognition technology to identify individuals. Without your explicit consent,
we will not use your personal data for direct marketing or disclose it to third
parties for direct marketing purposes.
在收集您的個人資料時，我們將採取一切合理可行的措施以確保您的資料保密。所收集的個人資料僅用於內部用途，或用於人面識別技術以識別個人。

b) Members are required to
wipe down all equipment with the supplies provided by EFX24 after each use, and
to tidy up and return the equipment to its original position.

c) This membership is for the Member only and the Membership shall not give access to another individual. Should there be any violation of this rule by the Member, EFX24 reserve the right and discretion to immediately terminate the Membership and demand for monetary penalty in the sum of $__________ or equivalent to membership fee for 1-month membership in accordance with the Price List in effect at the time being, whichever higher against the Member;

d) The Member shall not misuse the equipment and only use the equipment in accordance with the guidelines posted in the Facility;

e) The Member shall be at least eighteen (18) years of age, unless otherwise authorized by EFX24.
會員須最少年滿18歲，除非EFX24另作許可。
f) The Member shall conduct themselves in a quiet, well-mannered fashion so as not to cause any disturbance which may interfere with the use and enjoyment of the Facility by any other member. Profanity or indecent language and/or behavior will not be tolerated. Any conduct deemed by EFX24, in its sole discretion, to be offensive, potentially harmful. dangerous or abusive will not be tolerated, and shall be grounds for termination of Member’s membership by EFX24:

g) EFX24 shall not be responsible for any lost or stolen items

h) The Member should not occupy any equipment for an extended period of time and should allow others waiting to use such equipment to work into their rotation; and

i) The climate of the Facility is controlled by EFX24 and is set to provide the optimum exercise environment for the majority of its members. The Member shall not change or seek to change any environmental controls and shall never prop open any doors or windows to the Facility for any purpose.

3. Alcohol, drugs (including steroids), and smoking are prohibited within the Facility. The Member agrees not to use the Facility or engage in any activity at EFX24 while under the influence or drugs, alcohol, or medication that may impair Member's ability to operate the equipment. No weapons of any kind are allowed. No photography, videotaping, filming or audio recording is permitted within the Facility without the express written consent of EFX24’s management. EFX24 reserves the right in its sole discretion, to limit the consumption of food or beverages, or to the use of outside equipment within the Facility. Gambling or gaming is prohibited within the Facility or on the premises.
設施内嚴禁飲酒，吸毒(包括類固醇)和吸煙，會員同意不會在毒品，酒精或藥物以致影響會員操作器材的情況下使用設施或進行任何EFX24的活動。

4. EFX24 requires that Members wear appropriate clothing and footwear while in the Facility. Appropriate clothing includes gym shorts, T-shirts, jogging suits, aerobic wear and sweat outfits. Street clothing and jeans are not considered appropriate clothing. Street shoes and black-soled shoes are prohibited within the Facility. The Members agrees to have a cloth towel during workouts to protect and clean the equipment after Member’s use.
EFX24要求會員在設施內須穿著適當衣物和鞋履。適當衣物包括健身短褲、T-Shirts、跑步裝束、拉筋裝束和運動裝束，街頭服裝和牛仔褲不視為適當衣服，設施內嚴禁穿著街頭服裝和黑皮鞋。會員同意在運動時自備毛巾以在使用器材後進行保護和清潔。
5. EFX24 may update their policies and practices in relation to the use of the Facility from time to time. They will notify the Members about the significant changes as made to its policies or practices by placing a notice in respect of such changes on its website or in its Facility;

6. The Member agrees and acknowledges that his use and enjoyment of the Facility and/or services provided by EFX24 under this Agreement may be limited problem, difficulties and/or incapability of himself/herself and that the Member is still obliged to make full payment of the Membership Fees and other charges under this Agreement and EFX24 shall not in any event refund in whole or in part any of the fees payable by the Member under this Agreement.
會員同意和知悉其自身存在的問題、困難和/或喪失能力的情況有可能妨礙會員全面使用及/或享受根據此協議由EFX24提供的設施和/或服務，

7. Members are strictly
prohibited from receiving paid or unpaid fitness instruction from coaches not
affiliated with EFX24. All fitness coaching must be authorized and approved by EFX24.
Any violation of this clause may result in the immediate termination of the
member's membership.
會員嚴禁接受EFX24以外的教練提供授薪或非授薪的健身指導，所有健身教學必須經過健身室的授權和批准。任何違反此條款的行為將可能導致會員會籍的即時中止。
8. Members
are informed that they may apply for a membership suspension under the terms of
this agreement, with a written request submitted at least 30 days in advance,
and the payment of a monthly suspension fee of $250. The minimum suspension
period is one full calendar month, with a maximum of three months allowed
within the same year or contract period (based on the earliest expiration
date). The total months of membership suspension will not count towards the
service commitment period and must be made up after the membership contract
expires. Any gifted months will be compensated after the completion of the
service commitment period.
During
the suspension period, members are prohibited from entering or using any
facilities and/or services provided by EFX24. The decision to suspend
membership is at the sole and absolute discretion of EFX24 and may take effect
immediately.

9. When collecting your personal data,
we will take all reasonable measures to ensure its confidentiality. The
collected personal data will be used solely for internal purposes or for facial
recognition technology to identify individuals. Without your explicit consent,
we will not use your personal data for direct marketing or disclose it to third
parties for direct marketing purposes.
